1. Scope of Application
The following General Terms and Conditions apply to all orders placed through our online shop by consumers and entrepreneurs.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
For entrepreneurs: If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby rejected; they only become part of the contract if we have expressly agreed to them.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with Healthyscape.
By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products non-bindingly in the shopping cart and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose during the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.
3. Contract Language, Storage of Contract Text

We store the contract text and send you the order data and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Delivery Conditions
We deliver free of shipping costs.
You generally have the option of picking up your order at

We do not deliver to parcel stations.
5. Payment
In our shop, the following payment methods are generally available to you:
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal after the goods have been shipped. Further information can be found during the order process.
Payment processing by PayPal Services
In cooperation with the payment service PayPal, we offer you various payment methods as PayPal Services. You do not need to be registered with PayPal to pay the invoice amount. Depending on the selected payment method, you may be redirected to the PayPal website and the selected payment service after placing the order: credit card, Giropay, direct debit or Sofort by Klarna. 6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.
7. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following restrictions and reductions of deadlines do not apply to claims for damages caused by us, our legal representatives, or vicarious agents: in case of injury to life, body, or health, in case of intentional or grossly negligent breach of duty and malice, in case of breach of essential contractual obligations (cardinal obligations), within the scope of a guarantee promise, or insofar as the scope of the Product Liability Act is opened.
For entrepreneurs, the statutory provisions of the German Commercial Code (HGB, § 377) apply, as well as a shortened limitation period of one year from the transfer of risk, unless otherwise agreed.
8. Publication and Copyright
(1) Individually manufactured works (e.g., moss pictures, natural artworks or custom-made products) may – unless expressly agreed otherwise – be displayed, published or reproduced in an adapted form as part of the Healthyscape collection.
(2) The copyrights to all drafts, designs, digital templates and compositions remain with Healthyscape, owner Martin Schinköth. With the acquisition of a work, the client is exclusively transferred ownership of the physical object. A transfer of usage, reproduction or exclusive rights only takes place if this has been expressly agreed in writing.
(3) Healthyscape is entitled to use photographs and illustrations of the manufactured works for presentation and advertising purposes (e.g., on the website, in social media, brochures or online shops), provided that no personal data, private rooms or individual customer information are disclosed.
(4) If the client expressly requests that a commissioned work not be published, this must be communicated in writing before placing the order. Healthyscape will, of course, respect this wish.
9. Liability
For claims due to damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation in case of injury to life, body or health, in case of intentional or grossly negligent breach of duty, in case of guarantee promises or insofar as the scope of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence, liability is limited in amount to the foreseeable damage at the time of conclusion of the contract, the occurrence of which must typically be expected. In all other respects, claims for damages are excluded.

We are willing to participate in an out-of-court conciliation procedure before a consumer arbitration board.
The competent body is the Universal Arbitration Board of the Federal Government at the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.
12. Final Provisions
If you are an entrepreneur, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
